Terms of Service

1. Purpose
gogeehaw ("we") publishes an online application for dog owners ("users"), enabling pack management, sport and health tracking, and access to AI-assisted informational tools.
2. Acceptance
By creating an account, the user accepts these Terms without reservation. Some features (AI-assisted canine health modules) require additional dedicated acceptance, documented by a database timestamp.
3. Nature of the service
gogeehaw provides information of a guidance and organisational nature. The service does not constitute a veterinary consultation in any way, does not establish a medical diagnosis and does not prescribe any treatment. Output produced by artificial intelligence is indicative and must always be validated by a licensed veterinarian.
4. Limitation of liability
Items produced by the service (analyses, training recommendations, AI-assisted canine health suggestions, weather verdicts) are provided for informational and orientation purposes. They do not replace the judgment of a licensed veterinarian, certified sports coach, or human health professional.
To the extent permitted by law, and except in cases of gross negligence, wilful misconduct or bodily injury where limitation is prohibited, gogeehaw's potential liability to a consumer user is limited to the sums actually paid by that user over the last twelve months.
Partial nullity — consumer rights preserved. Nothing in these Terms can be interpreted as excluding or limiting the mandatory rights the user holds under the Quebec Consumer Protection Act or EU Directive 93/13/EEC on unfair terms. Should a clause prove contrary to those mandatory provisions, it would be deemed unwritten without affecting the validity of the other clauses.
5. Pricing, payment and billing
The service is offered as subscriptions (bundles or à la carte modules). Prices are shown in Canadian dollars, taxes extra where applicable, and are visible before every transaction. Payment methods are collected and stored via Stripe (PCI-DSS Level 1 certified); gogeehaw never stores the full card number.
No charge can occur before you have been informed and have confirmed your post-beta subscription choice. An electronic invoice is issued for each charge, accessible from your Account section.
6. Cancellation, right of withdrawal and refund
Users residing in Quebec — 10-day right of resolution (art. 54.1 et seq. CPA). You have 10 days from contract conclusion at a distance to cancel your subscription without penalty or justification. To exercise this right, send a clear notice to support@gogeehaw.com with your account email. A full refund occurs within 15 days of receiving your request, by the original payment method.
Users residing in the EU — 14-day right of withdrawal (Directive 2011/83/EU). You have 14 days to withdraw from the contract from its conclusion. Same procedure as above. If you choose to start using the service immediately, you acknowledge losing this right for the portion already consumed (art. 16.m).
Cancellation beyond the legal deadline. You can cancel your subscription at any time from your Account section or by email. Cancellation takes effect at the end of the current period; no further sums are due. No prorated refund of remaining days is issued outside the withdrawal window, except in cases of serious and characterized service failure on our part.
Post-withdrawal refund. In case of billing error, double charge, or prolonged service inaccessibility on our part (more than 7 consecutive days), you can request a prorated refund by email — reviewed case by case and processed within 15 days.
7. Intellectual property
All service elements (code, logo, editorial texts, catalog, brands) are the property of gogeehaw or its licensors. User-submitted data (dog profiles, photos, notes, imported sessions) remains the user's exclusive property.
8. User content — license and warranties
By uploading content (dog photos, training notes, GPS files, health records), you grant gogeehaw a non-exclusive, worldwide, royalty-free and revocable license strictly limited to operations needed to provide the service: storage, indexing, image resizing, preview generation, transmission to the authenticated user's browser. This license ceases automatically when the content or your account is deleted. No marketing use, resale, or transfer to a third party occurs without your explicit prior consent.
You warrant that you hold the necessary rights to the uploaded content — in particular for photos containing identifiable people (right of image), or content protected by copyright. You indemnify gogeehaw against any third-party claim on this basis.
8 bis. Third-party integrations — Strava, Garmin, others
gogeehaw allows you to optionally import your activities from third-party platforms (notably Strava, and indirectly Garmin via Strava). These imports require an explicit OAuth authorization that you trigger yourself.
Regarding the data thus imported:
- It is used and displayed to you only, never shared with other gogeehaw users, nor made public by us.
- It is never sold, rented, sublicensed or transferred to a third party, including in aggregated or anonymized form, and including in the event of a merger or acquisition of gogeehaw (such an event would be notified to Strava and to you beforehand).
- It is never used to train, fine-tune or evaluate an artificial intelligence model. The AI analyses offered by gogeehaw (coach, recommendations, comparisons to a plan) are inference calls to Anthropic Claude under a Zero-Retention addendum — data transits, is not stored on the provider side, and feeds no training corpus.
- When you revoke gogeehaw's authorization from strava.com, or when you delete an activity on Strava, the corresponding data is erased from our databases within a maximum of 48 hours via the athlete:DeAuthorization and activity:delete webhooks. Disconnecting from gogeehaw's Connections page stops sync but keeps your imported sessions in your log (deletable individually at any time). You can also request a manual deletion at support@gogeehaw.com.
- gogeehaw charges no specific fee for Strava access itself: your gogeehaw subscription covers gogeehaw-specific features (analyses, multi-dog attribution, go/no-go weather, breeding, races), which add to Strava without replacing it. Strava remains accessible separately under terms defined by Strava, Inc.
Strava is a registered trademark of Strava, Inc. Any mention of Strava on gogeehaw is made for purely descriptive and factual purposes, in accordance with the Strava API Brand Guidelines and the Strava API Agreement. gogeehaw is neither developed, sponsored, nor endorsed by Strava.
9. Rights infringement notice (takedown procedure)
If you believe content hosted on gogeehaw infringes your rights (copyright, trademark, right of image, privacy), send a detailed notice to support@gogeehaw.com specifying: (a) your identity and capacity to act, (b) the disputed content and its URL, (c) the basis of the claim, (d) a sworn declaration of the truthfulness of the information. gogeehaw reviews the request within 14 days and removes or retains the content based on a good-faith assessment. This procedure follows the principles of the US DMCA and EU directive 2019/790, without however qualifying gogeehaw as a host in the technical sense.
10. Termination
You can terminate your account at any time from the Account screen. Deletion entails erasure of personal data within 30 days, except for legal retention obligations (Stripe invoices: 7 years). See also section 6 for the withdrawal right and refund policy.
11. Minors
The service is intended for adults or for minors with parental authorization. The minimum age is 13 in the United States (COPPA), 14 in Quebec, and 16 in the EU/EEA — gogeehaw applies the most protective threshold for the user's jurisdiction. An account created by a minor without the required authorization is terminated by right upon notification.
12. Applicable law and competent jurisdiction
These Terms are governed by Quebec law. Any dispute falls under the competence of Montreal courts, subject to the mandatory consumer protection provisions of the user's local law (notably the consumer's right to seize the court of their domicile in the EU under the Brussels I bis regulation).
13. Modification of the Terms
gogeehaw may modify these Terms at any time. Any substantial modification is notified to the user by email with at least 30 days' notice, during which the user can cancel the subscription free of charge if they do not accept the new conditions.
